Dual Occupancy development under the provisions of SEPP No.53 continues to be permissible in Ku-ring-gai although council has commenced the process of developing its own policy and controls for this form of development which it hopes will see it granted an exemption from SEPP No.53. The current timetable is such that a draft LEP will be put on exhibition towards the end of this year with anticipated controls including an increased minimum allotment size of 1000m2-1200m2 as opposed to the current 600m2 minimum and a decrease in the maximum floor space ratio from 0.5:1 to 0.4:1. We do not fully support these changes and will be making submissions to the Minister at the appropriate time.

It is therefore advised that if you intend to carry out dual occupancy development that now is the time to be making an application to Council.

The BASIX Alterations and Additions scheme came into effect on the 1 October 2006.

You will now require a BASIX certificate to accompany your Development Application if:

1.   Your renovation work is valued at $50,000 or more. (From 1 July 2007)
2.   You are installing a swimming pool (or pool and spa) with a capacity greater than 40,000L.
